If there is a conflict between these terms and the specific wording of a written quote, the specific wording of the quote prevails for the matters covered by that quote. This lets us adapt standard terms to the details of a particular job without weakening the protections in this document.

2. Developer and Operator

This website and the services described on it are developed and operated by the developer FixNGoy for and on behalf of Fixngo Now Inc. Fixngo Now Inc. is the organization responsible for delivering the services and for honoring these terms.

All references in these terms to Fixngo Now Inc., the company, we, us, or our refer to Fixngo Now Inc. and, where appropriate, the developer FixNGoy acting under its direction. Any reference to you or the client refers to the person or organization engaging our services.

3. Eligibility and Acceptable Use

Our services are intended for individuals who are at least 18 years of age and for businesses operating lawfully. By engaging our services you confirm that you are legally able to enter into a binding agreement and that you own the device or have the authority of the owner to authorize work on it.

You agree to use our website and services only for lawful purposes. You will not attempt to interfere with the operation of our website, introduce malicious software, or access our systems without authorization. You will not use our services in a way that violates the rights of any third party.

4. Description of Services

Fixngo Now Inc. provides professional computer systems design and related services, including computer repair and diagnostics, computer systems design, computer integrated systems design, data recovery and backup, virus removal and security hardening, and business continuity and managed care planning.

The specific scope of each service is defined in the written quote we provide before work begins. A quote describes the fault or project, the work to be performed, the parts or hardware involved, the expected timeline, and the total price. Our services do not include ongoing software licensing unless such licensing is expressly listed in the quote.

We may decline to provide a service when we reasonably believe that doing so would be unlawful, unsafe, or impossible to complete to a professional standard.

Our technicians hold the skills needed to work across the major computer platforms, including Windows, macOS, and common Linux distributions, as well as the networking equipment found in most small offices. If a project requires a specialized certification that we do not hold, we will tell you honestly and recommend a qualified specialist rather than attempt the work beyond our expertise.

We maintain a professional standard of workmanship on every job, whether it is a five-minute configuration change or a multi-week integration project. The same care, documentation, and testing applies to every device that comes through our bench.

5. Quotes, Fees, and Payment

All prices are provided in Canadian dollars unless stated otherwise. Our standard workflow is to provide a written quote after diagnosis and before any chargeable work begins. Diagnostics that require significant bench time may be subject to a diagnostic fee, which will be disclosed to you before we proceed.

You authorize us to proceed with the quoted work by accepting the quote in writing, by email, by phone, or by returning the signed quote document. Payment is due as stated in the quote, which may require a deposit for parts or for large projects. Accepted payment methods are listed on the quote and on invoices.

If a repair requires additional work beyond the quoted scope, we will stop and obtain your approval before continuing. You will never be charged for work you did not approve.

Taxes, shipping, and any applicable environmental fees are shown separately on your quote and invoice so that the final amount is never a surprise. If a fee changes before your job is billed, we will confirm the revised amount with you first. Our aim is that the number on your approved quote matches the number on your invoice.

For recurring or managed services, invoices are issued on the schedule stated in your service agreement. Payment terms for those invoices are also stated in the agreement. A late payment may suspend the related service until the account is brought up to date.

6. Client Obligations

To help us serve you well, you agree to provide accurate information about the device, the fault, and any relevant history. You agree to remove any locks, passwords, or access restrictions you are able to remove before service, or to provide the access details needed to complete the work in a secure manner.

You are responsible for backing up any data you require before we service the device, unless a backup or data preservation service has been expressly included in the quote. You agree to inform us before service if the device contains any data that is sensitive, regulated, or critical to your business.

For on-site work, you agree to provide reasonable access, a safe working environment, and a responsible person who can answer questions about the environment.

You also agree to inform us of any known hazards or special conditions at the work site, such as restricted areas, environmental conditions, or equipment that must not be powered down. Accurate and complete information helps us plan the job properly and avoids delays. If you are unsure whether a detail matters, please mention it; it is better to include extra context than to leave out something important.

7. Repair Process and Authorizations

Our standard process follows four steps: report the issue, diagnose and quote, repair and integrate, and verify and hand back. You authorize us to open the device, perform diagnostic testing, and install the parts and software described in the approved quote.

We may replace failed parts with quality components selected by us or specified in the quote. Where a part is unavailable, we will contact you to discuss an equivalent alternative. We will retain any replaced parts for your inspection or return them to you on request.

We apply our standard testing and stability procedures before handing a device back. You confirm receipt of the device and the handover summary when you accept delivery.

8. Data Handling and Confidentiality

We treat all data on your device and all information you share with us as confidential. We access your data only to the extent needed to complete the service you requested. We do not copy, distribute, or retain your data beyond the scope of the service, and we do not sell or share it with third parties except as described in our Privacy Policy.

Where a quote includes backup or data preservation, we will follow the backup procedure described in that quote. Unless explicitly agreed, we do not guarantee the preservation of data during a repair, which is why we recommend that clients maintain their own backups.

9. Data Recovery and Its Limitations

Data recovery is performed with best efforts using professional tools and techniques. We work on read-only copies where the condition of the drive allows, to protect the original media from further damage.

No data recovery provider can guarantee the recovery of every file from every failed device. Physical damage, firmware failures, and extensive logical corruption can make some or all data unrecoverable. You will be advised of the likelihood of recovery during diagnosis, and you may cancel a recovery attempt at any point before it begins.

Charges for data recovery apply regardless of the outcome, because the diagnostic and recovery effort is the service being purchased. Any partial recovery will be delivered to you as received.

Before a recovery attempt, we will explain the condition of the drive and the probability of success based on our initial inspection. You decide whether to proceed. During a recovery we work methodically, capturing what can be saved and documenting the condition of the media so that the outcome is transparent and reproducible.

We strongly recommend that you do not attempt your own recovery on a drive that contains irreplaceable data. Running recovery software on a failing drive can overwrite the very sectors that hold your files. Stopping the drive and sending it to a professional is very often the difference between a full recovery and a permanent loss.

10. Warranty Terms

Fixngo Now Inc. provides a 90-day workmanship guarantee on labor performed, starting from the date of handover. If the repaired fault returns within 90 days under the same conditions and we determine that the failure is due to our workmanship, we will correct the fault at no charge for labor.

The workmanship guarantee does not cover parts that fail due to manufacturer defect, physical damage, liquid damage, misuse, unauthorized modification, or damage caused after handover. Parts carry the warranty of their manufacturer, which we will help you claim where applicable.

Our guarantee covers the labor we perform, which is the part of the service we directly control. We document the work we do so that a warranty claim can be assessed quickly against the record of the original repair. If we accept a warranty claim, we prioritize it so that your machine is not out of service longer than necessary.

11. Cancellations and Refunds

You may cancel a service request at any time before work begins, without charge. If you cancel after we have begun diagnostic work or after parts have been ordered, you will be charged for the diagnostic work performed and for parts that cannot be returned, at their cost.

If we cannot complete the approved service for any reason, we will refund the amount paid for the uncompleted portion of the work. Deposits for parts are refundable only if the parts are returned in their original condition and packaging.

Refunds are issued using the original payment method within a reasonable period after the refund is approved.

12. Intellectual Property

All content on the Fixngo Now Inc. website, including text, graphics, logos, and the design of the site, is the property of Fixngo Now Inc. or its licensors and is protected by copyright and other intellectual property laws. You may view and print content for personal, non-commercial use only.

Any software we install as part of a service remains subject to its own license terms. Any documentation, diagrams, or handover materials we prepare for you are for your internal business use. You may not reproduce or distribute our proprietary materials without written permission.

13. Limitation of Liability

To the maximum extent permitted by law, Fixngo Now Inc., the developer FixNGoy, and their employees and contractors are not liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services. This includes loss of data, loss of profits, loss of business, or interruption of operations.

Our total liability for any claim arising out of or relating to a single service engagement is limited to the amount you paid for that engagement. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for gross negligence or willful misconduct.

14. Disclaimers

Our website and services are provided on an as is and as available basis, without warranties of any kind, either express or implied, except as expressly set out in these terms or required by law. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components.

Repair outcomes depend on the condition of the device and the accuracy of the information you provide. We make reasonable efforts to provide accurate estimates and timelines, but we do not guarantee specific completion dates unless one is expressly stated in the quote.

Information on our website is provided for general guidance about our services and is not a technical guarantee about any particular device or outcome. Actual performance and results depend on the specific hardware, software, and conditions involved. For authoritative advice about your equipment, rely on the written quote and the handover documents we prepare for your specific job.

15. Termination

We may suspend or terminate your access to our website at any time if we reasonably believe you have breached these terms. We may also decline or stop providing a service if continued work would be unlawful, unsafe, or contrary to professional standards.

Upon termination, you remain responsible for payment for all work performed and all parts supplied up to the date of termination. Sections of these terms that by their nature should survive termination, including warranty limits, liability limits, and dispute resolution provisions, will continue to apply.

16. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Nova Scotia, Canada, and the applicable laws of Canada, without regard to conflict of law principles. Any dispute arising from these terms or from our services will be resolved through the courts of Nova Scotia.
